ACTION: Final rule. ---------------------------------------------------------------------------- SUMMARY: This document adopts as a final rule without change an interim rule adding a diagnostic code and evaluation criteria for chronic fatigue syndrome to the VA Schedule for Rating Disabilities. The intended effect of this rule is to insure that veterans diagnosed with this condition meet uniform criteria and receive consistent evaluations. EFFECTIVE DATE: This final rule is effective July 19, 1995. The interim rule was effective November 29, 1994. SUPPLEMENTARY INFORMATION: On November 29, 1994, VA published in the Federal Register an interim rule with request for comments (59 FR 60901). The rule added a diagnostic code (DC 6354) and evaluation criteria for chronic fatigue syndrome to the section of the VA Schedule for Rating Disabilities (38 CFR Part 4) on systemic diseases (38 CFR 4.88b). A 60-day comment period ended January 30, 1995, and no comments were received. Based on the rationale set forth in the interim rule document, we are adopting the provisions of the interim rule as a final rule without change. This final rule also affirms the information in the interim rule document concerning Regulatory Flexibility Act. The Catalog of Federal Domestic Assistance program numbers are 64.104 and 64.109.
